USER AGREEMENT
This software is licensed to you (hereafter referred to as “the user”) by Ksignals.com subject to the terms and conditions of this license agreement.
[DESCRIPTION OF SOFTWARE]
Master Trend is a trading system that runs on the Meta Trader 4 platform. It is designed to alert the user for possible trade opportunities.
[LICENSE]
Ksignals.com is licensing the user the right to use the software during the time this agreement is in effect subject to the user’s compliance with the terms and conditions of this agreement. The software is licensed to the user for the sole purpose of engaging in personal and not commercial use. Provided you do so in accordance with the terms and conditions of this agreement. All rights relating to the software that are not expressly stated in this agreement whether now or those that may come into existence are reserved for Ksignals.com. This license shall terminate immediately upon violation by the user of this agreement.
[PROHIBITED CONDUCT]
The user represents and warrants that they will not violate any of the requirements of this agreement and further represents and warrants that:
1. You will not and will not permit others to (I) reverse engineer, decompile, disassemble, derive the source code of, modify, or create derivative works from the software, or (II) copy, distribute, publicly display or publicly perform the software other than expressly authorized in this agreement.
2. The user will not use the software to engage in or allow others to engage in any illegal activity.
3. The user will not sell the software or charge others for the use of the software. The user will not sell signals from this software or broadcast its signals in any way whatsoever.
4. The user will not use the software to engage in any activity that will violate the rights of third parties, including without limitation through the use, public display, public performance, reproduction, distribution or modification of communications or materials that infringe copyrights, trademarks, publicity rights, privacy rights, other proprietary rights, of rights against defamation of third parties.
[RELEASE OF INDEMNITY]
The user agrees to release, defend, indemnify and hold harmless Ksignals.com, its officers, directors, employees, agents, independent contractors, lawyers, accounts, parent companies, subsidiary companies, affiliates, successors, and assigns, from and against any and all liability, claims, actions or demands by the user or any other party resulting from or relating to the use or misuse or the software. You waive all laws that may limit the efficacy of such a release or indemnity.
[DISCLAIMER OF WARRANTIES, REFUNDS, AND LIMITATION OF LIABILITY]
The software is supplied “AS IS” and all use is at your own risk. Ksignals.com disclaims all warranties of any kind either expresses or implied, as to the software, including, but not limited to implied warranties of fitness for a particular purpose, merchantability or non infringement of proprietary rights. Neither this agreement nor any documentation furnished under it is intended to express or imply any warranty that the operation of the software will be uninterrupted, timely, or error free.
Ksignals.com does not accept returns of the software under any circumstances. All sales of the software are final and no refund will be made for any reason.
UNDER NO CIRCUMSTANCES SHALL KSIGNALS.COM BE LIABLE TO ANY USER FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES (EVEN IF KSIGNALS.COM OR ITS OFFICERS HAS BEEN ADVISED OF THE POSSIBILTY OF SUCH DAMAGES) ARISING FROM OR RELATING TO THIS AGREEMENT, THE SOFTWARE OR USER’S USE OR MISUSE OF THE SOFTWARE OR ANY OTHER SERVICES PROVIDED BY KSIGNALS.COM , SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM THE USE OR MISUSE OT THE SOFTWARE OR ANY OTHER SERVICES SUPPLIED BY KSIGNALS.COM (INCLUDING SUCH DAMAGES INCURED BY THIRD PARTIES) OR ERRORS OF THE SOFTWARE.
[INTELLECTUAL PROPERTY]
By accepting this agreement, you acknowledge that, Ksignals.com is the owner of all intellectual property rights in and to the software including copyright, trademark, patent, trade secret and all proprietary rights that are exist throughout the world.
[CHOICE OF LAW, JURISCICTION, AND VENUE]
This agreement shall be governed by and construed in accordance with the laws of the United States of America. The U.S.A. Courts shall be the exclusive jurisdiction, forum, and venue to resolve any and all disputes arising out of or relating to this agreement. You consent to personal jurisdiction and venue in state.
[MODIFICATION]
Ksignals.com reserves the right to modify or amend this agreement at any time and for any reason or for no reason at all, in its sole discretion, without notice.
[TERM AND TERMINATION]
This agreement is terminable at will by the user or Ksignals.com for any reason or for no reason at all, at either the users or Ksignals.com sole discretion. This agreement shall terminate immediately upon any breach by the user. Upon termination, the user agrees to discard all copies of the software. All provisions of this agreement by which their nature extend beyond termination remain in effect until fulfilled and apply to respective successors and assigns.
[MODIFICATION OF SOFTWARE]
Ksignals.com reserves the right to modify the software at any time for any reason. Ksignals.com also reserved the right to cease offering the software at any time and for any reason.
[REGISTRATION AND ACCCEPTANCE]
By installing or loading the software, the user represents and warrants that he or she is 18 years or older, and is capable entering into a binding legal agreement and has read, understands, and agrees to be bound by all provisions of this agreement. Any parent or guardian of a person under the age of 18 may accept this agreement on behalf of a user. By doing so, any such parent of guardian represents or warrants that he or she is 18 years or older, is capable of entering into a legally binding agreement, agrees to accept full responsibility for the child’s use of the software and has read, understands, and agrees to be bound by the agreement.
[AGREEMENT TO COLLECT FEES]
User understands and agrees that if the subscription or lease plan includes a recurring fee, the fee will be billed through PayPal every 30 days or as agreed upon at the time of purchase and the user agrees to make payment to Ksignals.com within 5 days of billing.
